General terms and conditions for listing properties


When a property is listed without a specific agency contract, our general terms and conditions for listing space in open mandate will apply:

Aximas will list the property based on the vacancy listings as communicated by the principal whereby an non-exclusive agency instruction will be established. Either party may terminate this instruction at any time in writing or by email.

Aximas is entitled to a fee when the Property has been leased or sold to a prospect introduced by Aximas.

When multiple parties present the Property to the same candidate, only the first visit to the Property shall be considered as a valid introduction. The Principal shall honor an undeniably fixed appointment for a viewing, unless the candidate himself would cancel.

For the letting of serviced offices in business centers, the broker does not have to be present at the viewing with the prospect. Transferring the prospect’s contact information to make a direct proposal will also be considered a valid introduction.

Unless otherwise agreed, the fee is set at 10% on the basic price for a lease of max 1 year, 15% on one year's base rent for a lease of 3-years firm (3-6-9), 20% on one year’s rent for a lease of 6-years firm (6-9) or 25% for lease of a 9-years firm. The commission is latest due upon reception of the first rent, or on reception of the guarantee, or on occupation of the premises. In case of a sale, the commission is 3% on the sale price unless agreed otherwise during the sales process. In case of sale, the commission is paid by deduction from the sale price at the time of execution of the deed.

21% VAT will be added to the fee.

Belgian law shall apply.
