Registration of a lease of common low or a retail lease

In the case of a common law lease or a retaill lease, registration is fee-based and usually the tenant bears the registration costs.

A lease for commercial property such as a shop or office space has to be registered.

Both the tenant and landlord are responsible for registering the lease within 4 months. If this is not done (on time), both parties can be fined for this.

In most leases, the cost of registration is charged to the tenant. It amounts to 0.2% of the total amount of the rent and charges imposed on the tenant for the duration of the lease. If it concerns a lease of indefinite duration, the annual rent and charges must be multiplied by ten and the registration fee concerns 0.2% of the amount thus obtained.

The only exception to the payment of the registration fee of 0.2% is the rental of storage spaces and parking spaces, where only the fixed registration fee of €50 must be paid.

Because of the registration, the rental agreement is opposable and therefore enforceable against, for example, future buyers of the property and the rental agreement must be respected by parties other than the landlord and tenant included in the rental agreement.
